1. Acceptance of Terms

By accessing or using Postiify (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Postiify is a multi-platform social media management tool that allows you to upload video content once and publish it across multiple social media platforms including Instagram, YouTube, TikTok, and Facebook. The Service includes AI-powered caption generation, post scheduling, and analytics.

3. Account Registration

• You must be at least 16 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• One person may maintain only one account

4. Your Content

You retain all ownership rights to the content you upload to the Service. By using the Service, you grant us a limited license to:

• Store your content on our servers for the purpose of providing the Service
• Transmit your content to the social media platforms you select for publishing
• Generate thumbnails and previews of your content within the application

You are solely responsible for the content you publish through the Service. You must have the necessary rights to publish any content and must comply with each platform's community guidelines and terms of service.

5. Acceptable Use

You agree not to use the Service to:

• Publish content that is illegal, harmful, threatening, abusive, or defamatory
• Infringe on any third party's intellectual property rights
• Distribute spam, malware, or any form of unsolicited content
• Attempt to gain unauthorized access to the Service or its systems
• Use automated tools to access the Service beyond the provided API
• Resell or redistribute the Service without authorization
• Violate the terms of service of any connected social media platform

6. Plans and Billing

• Free Plan: Limited features with usage caps as described on the pricing page
• Paid Plans (Creator, Pro): Billed monthly. Prices are listed on the pricing page and may change with 30 days' notice
• Payments are processed securely through our payment provider (Stripe)
• You may cancel your subscription at any time. Access continues until the end of the billing period
• Refunds are available within 14 days of initial purchase if you have not exceeded the Free plan usage limits

7. Third-Party Platforms

The Service integrates with third-party social media platforms. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the actions, content, or policies of any third-party platform. If a platform changes its API, restricts access, or modifies its terms, certain features of the Service may be affected.

8. AI-Generated Content

The Service offers AI-powered caption generation. AI-generated content is provided as a suggestion only. You are responsible for reviewing, editing, and approving all content before publishing. We make no guarantees about the accuracy, appropriateness, or effectiveness of AI-generated captions.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from service interruptions or failures to publish content on time.

10. Limitation of Liability

To the maximum extent permitted by law, Postiify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data as described in our Privacy Policy.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
